Payment Terms
Operator: [rechtsvorm en naam exploitant], with its registered office in [plaats], office address: [adres], registered in the trade register of the Netherlands Chamber of Commerce under number [KvK-nummer], VAT number [btw-nummer], e-mail: [contact e-mail], website: qoinomics.com.
These Payment Terms belong to the Terms and Conditions of Qoinomics and form part of them. They take precedence over the Terms and Conditions, except where specific purchase information in the service states otherwise. They only apply to consumers who are not acting in the course of a profession or business.
Read this first — short
- Qoins are game credit for use within Qoinomics. You cannot exchange them for money.
- Only buy what you want to spend. You can have unspent Qoins refunded within 14 days.
- You see prices in euros, including VAT, before the purchase.
- If you are under 18, ask your parent/guardian for permission first.
Article 1 — Definitions
Qoins: digital credits that can be spent within the Qoinomics service, bought with money via a payment method.
Purchase value: the amount in euros that you actually paid for the Qoins, including applicable discounts and promotional rates.
Spent Qoins: Qoins that have been used for a purchase within the service.
Right of withdrawal: the statutory right to cancel a distance purchase within 14 days.
Durable medium: any means that allows you to store information in such a way that you can consult it later (for example e-mail or a downloadable file).
Article 2 — Applicability
These terms apply to every purchase of Qoins and every paid service within Qoinomics (such as apartments and paid items), insofar as the Terms and Conditions do not contain more specific rules.
In the event of conflict: (1) statutory provisions that cannot be excluded by contract; (2) the specific purchase information with the product; (3) these Payment Terms; (4) the Terms and Conditions.
These terms are written for consumers. Business customers can only use and buy the service on the basis of separate terms agreed in writing.
Article 3 — Purchase of Qoins
Qoins are offered in the service in fixed packages, and individually for some paid items. What you buy and what it costs is shown in euros before the purchase, including VAT and any other costs.
Qoins are not money, not a security and not an investment. They can only be spent within the service, they are non-transferable, cannot be withdrawn and cannot be exchanged for money or value outside the service. You do not buy a right to a payout.
Qoins cannot be transferred from user to user. There is no "send Qoins to a friend" function.
With every purchase, an invoice or payment confirmation is provided stating the VAT and the identity of the seller.
Article 4 — Formation of the agreement
The agreement is concluded by pressing the purchase button and completing the payment. Qoinomics confirms the purchase by e-mail or within the service on a durable medium, stating: the content of the purchase, the price, the payment method, the date and these terms.
In the event of technical errors in the price (such as obvious typos), Qoinomics may correct or cancel the agreement and refund the amount paid; you will be informed of this within [7] days at the latest.
The language of the contract is Dutch (or English, German or Spanish if the service is used in that language); you receive the confirmation in the language of the purchase.
Article 5 — Payment methods and security
Qoinomics accepts the payment methods shown at checkout (such as iDEAL, credit card and other methods offered through Qoinomics' payment service providers).
Payments are processed by external, recognised payment service providers. Qoinomics itself does not store any card details.
A payment may be refused if fraud is suspected; you will be informed of this.
The terms of the payment method itself (such as the terms of your bank or card issuer) also apply to all payment methods.
Article 6 — Right of withdrawal
Statutory right of withdrawal. For a distance purchase, you in principle have a cooling-off period of 14 calendar days, without giving a reason, starting on the day the agreement is concluded (Article 6:230o of the Dutch Civil Code). If you exercise this right, you receive the full amount paid back, including delivery costs (which do not exist here) and without standard charges.
Exception for digital content supplied immediately. For digital content that is not supplied on a tangible medium and is supplied immediately, the law can exclude the right of withdrawal, but only under strict conditions: your express prior consent to immediate supply, your express acknowledgement that you thereby lose your right of withdrawal once supply has begun, and a confirmation of this on a durable medium (Article 6:230p of the Dutch Civil Code). In this draft phase, Qoinomics does not yet apply this exception to Qoin purchases. As long as that is the case, the statutory right of withdrawal in paragraph 1 applies in full.
Additional arrangement by Qoinomics (on top of the law). Qoinomics additionally offers: the value of unspent Qoins is always refunded in full at the purchase value within 14 days of purchase. This arrangement is an extra service and does not limit your statutory rights; if the statutory arrangement is more favourable to you, it applies.
Related credits and items. If a purchase is reversed (by withdrawal, cancellation or correction), Qoinomics only reverses those credits and rights of use that are lawfully connected with that purchase and that the law allows to be reversed. Whatever you had independently of that purchase remains.
How to withdraw. You can use the model withdrawal form (annex 1) or send another clear message to [contact e-mail] or via the complaints channel in the service. State who you are, which purchase it concerns and that you are withdrawing.
Refund. In the event of withdrawal, Qoinomics refunds the amount due without delay and at the latest within 14 days of the withdrawal to the original payment method. Qoinomics does not withhold any administration costs for the refund itself.
Separate services. For ongoing services (such as apartment terms) and individual items, the specific rules in the Terms and Conditions apply; the withdrawal arrangement per type of purchase is clearly communicated before the purchase.
Article 7 — Refunds and credits
Refunds are always made to the original payment method, unless you ask for another method and the payment service provider allows this (and it costs you nothing).
Unspent Qoins are refunded at the purchase value, not at a current valuation.
Returning stolen credits (due to misuse of your account) is a restorative measure, not a "payout" and not a cash-out right: it only restores the situation before the misuse, insofar as demonstrable and reported within a reasonable time.
Article 8 — Minors
If you are under 18, you need the consent of your parent or guardian for purchases.
Parents/guardians can ask Qoinomics to set purchase limits per account and can report unwanted purchases by their child via [contact e-mail]. If a purchase by a minor is void or voidable, we will deal with the consequences in accordance with the applicable law.
Qoinomics does not use any age verification at purchase that goes beyond account registration. This does not limit the statutory rights of minors and their parents.
Article 9 — Expiry
Paid Qoins do not expire.
Promotional Qoins granted free of charge may expire; the expiry date is stated when they are granted.
iQoins may expire after 24 months of inactivity; see article 7 of the Terms and Conditions.
Article 10 — Price changes
Qoinomics may change the prices of Qoins and paid services. Changes only apply to new purchases and are clearly announced within the service.
The price at the time of your purchase is the price that applies to your purchase.
Article 11 — Outages and compensation
If paid functions are unavailable for more than 72 consecutive hours due to a cause on the side of Qoinomics, Qoinomics compensates proportionally: in principle by extending the term or with credit within the service. A refund in money instead of credit is possible if you ask for it and the compensation relates to a service still to be supplied.
This compensation is a contractual arrangement and does not affect your statutory rights (such as the right to terminate in the event of a lasting failure to perform).
Article 12 — Fraud, chargebacks and incorrect payments
In the event of (suspected) payment fraud, Qoinomics may temporarily block the account. The block is limited in duration, communicated with reasons and can be disputed via the objection channel.
Qoinomics only reverses transactions that are demonstrably connected with the fraud. The entire balance is not automatically set off against claimed damages.
If a payment is reversed by the payment method (chargeback), Qoinomics will first get in touch to resolve the situation. A chargeback is not in itself evidence of fraud: a lawful withdrawal, a refund request or the use of your payment method's protection never leads to a sanction. Access restrictions are only possible if there are concrete indications of misuse, with reasons, limited in time and open to dispute.
False chargebacks (reversing payments while the purchase was delivered correctly) are a breach of these terms and may lead to measures under the Terms and Conditions, in addition to the statutory options of the payment method.
Article 13 — Complaints
You can submit complaints about payments via [contact e-mail] or the complaints channel in the service. Qoinomics confirms receipt and in principle responds within 14 days.
If you disagree with how your complaint was handled, you can contact the information and reporting point ConsuWijzer of the Netherlands Authority for Consumers and Markets (ACM) or a comparable point in your country; it does not resolve your dispute in a binding way, but helps you further. You can always go to court.
For cross-border complaints within the EU, you can contact the European Consumer Centre in your country (in the Netherlands: ECC-Net via ConsuWijzer).
Article 14 — Applicable law
Dutch law applies to these terms, subject to the mandatory consumer law of your country of residence if you live in another EU country.
As a consumer, you can bring proceedings before the court of your country of residence where the law permits.
Article 15 — Final provisions
These terms may be changed in accordance with article 22 of the Terms and Conditions; changes do not apply retroactively to purchases already made.
Invalid provisions are replaced in accordance with article 25 of the Terms and Conditions.
