Lizenzbedingungen für Items und Downloads
Operator: [rechtsvorm en naam exploitant], with its registered office in [plaats], office address: [adres], registered in the trade register of the Netherlands Chamber of Commerce under number [KvK-nummer], VAT number [btw-nummer], e-mail: [contact e-mail], website: qoinomics.com.
These terms belong to the Terms and Conditions of Qoinomics and form part of them. They are written in plain language; a short summary is at the top.
Read this first — short
- If you buy an item (clothing, furniture, accessory), you buy a right of use within Qoinomics, linked to your account. The file and the copyright remain with Qoinomics, but you do get enforceable rights, set out below.
- With some items you also get a downloadable 3D file. A separate personal licence applies to it: you may use the file locally, edit it and make back-ups, but you may not distribute or sell it.
- Limited editions are scarce because Qoinomics registers and limits the total number of copies issued within an edition — not because the file itself cannot be copied. Do not expect to make a profit from them: they are collectibles, not an investment.
- Resale is not yet active in this draft phase; whether and when it will be activated is a choice that still has to be confirmed. How it will then be set up (and what happens to your download) is set out in article 7.
- Do you leave Qoinomics, or does the world cease to exist? Then your download file remains usable under this licence (article 10).
Article 1 — Definitions
Virtual item: a digital object in the Qoinomics service, such as clothing, shoes, furniture, accessories and apartment furnishings.
Platform right (right of use): the contractual right to use a virtual item within the service, linked to your account.
Download file: a 3D file (for example in a common format such as [format to be completed]) supplied as an extra with certain purchases.
Download right: the personal licence to the download file, as described in article 6.
Limited edition: a virtual item for which Qoinomics limits the total number of copies issued within a named edition (article 5).
Edition / edition size: the maximum number of issued copies of a limited edition as registered and published by Qoinomics.
Registration: keeping track on the servers of which user holds which item and which copy (serial number).
Transfer: the passing of a platform right from one user to another through a function of the service itself (article 7).
Article 2 — Applicability and order of precedence
These licence terms apply to the purchase, earning and use of virtual items and (where supplied) download files.
In the event of conflict: (1) statutory provisions that cannot be excluded by contract; (2) the specific purchase information with the item (description, edition size, price, whether a download is included); (3) these licence terms and the Payment Terms; (4) the Terms and Conditions; (5) the code of conduct.
These terms apply to all users of the service. Insofar as a provision is only intended for consumers (such as the right of withdrawal), this is indicated or follows from the Payment Terms.
Article 3 — What you get when you buy or earn an item
You get enforceable rights. When you buy or earn a virtual item, you obtain a platform right: the right to use that item within the service, linked to your account. That right is real and protected: Qoinomics may not withdraw it unilaterally, except as permitted in these terms and the Terms and Conditions (for example in the event of demonstrable fraud, with reasons and the possibility to object).
No ownership of files, no copyright. You do not become the owner of the underlying file or 3D model, and no copyrights or other intellectual property rights pass to you. Qoinomics (or the rights holder from whom Qoinomics obtained the rights) remains the rights holder.
The platform right is personal and linked to your account. You cannot sell, exchange or transfer it outside the service (article 7 governs the exception via the service itself).
If you earn an item with iQoins, these licence terms also apply; only the payment side follows the rules on iQoins in the Terms and Conditions.
Article 4 — Use within the platform
You may use the item on your avatar, in your (rented) apartment and in other places where the service allows it.
You may combine the item with other items and create your own style.
You may make screenshots and videos of your avatar and your spaces with the items in them, and share them (also outside Qoinomics), provided you respect the code of conduct and the rights of others. Commercialising such recordings (for example as paid content) is a separate choice for Qoinomics: [policy choice — to be confirmed whether this is permitted].
You may not attempt to duplicate, clone or extract items outside the service, other than via the intended download function and acts permitted by law (article 8).
Article 5 — Limited editions and scarcity
How scarcity works. For a limited edition, Qoinomics limits and registers on its servers how many copies of a named edition are issued in total. At purchase, you see the total edition size and, where applicable, the edition number of your copy.
What the cap means exactly. The cap is the maximum number of copies issued during the lifetime of the edition: if copies lapse (for example because an account is terminated), no new copies are added to fill the gap. [To be confirmed: whether Qoinomics applies this total issue cap, or deliberately a cap on simultaneously active copies — the latter choice must then be stated at purchase, because it means less strict scarcity.]
A replacement is not a new copy. If your copy is restored after a technical error, you get the same registered copy back — no extra tradable right and no increase in the number issued.
Gift, reserve and test copies count within the published edition size or are stated separately with the edition. [To be confirmed: the exact arrangement.]
Re-issue. If Qoinomics later releases a virtually identical variant (for example only a different name or colour), it will clearly state this with that new edition. Such a re-issue does not detract from what was promised about the edition size at the original purchase.
Files are not proof of uniqueness. A downloadable file can technically be copied, and a serial number is a registration tool, not proof that the file is unique or cannot be copied.
No investment or profit promise. Limited editions are collectibles. Qoinomics does not promise any increase in value, any possibility of sale on an external market or absolute exclusivity, and does not encourage buying or giving away for profit. Item descriptions are honest: no misleading scarcity claims.
Article 6 — Downloadable 3D files
What you get. Where a download file is offered with an item, this is clearly stated before the purchase, including the file format, the main technical requirements (which software opens the file) and that this personal licence applies.
What you may do (personal licence). You may:
- open, view and render the download file in suitable software;
- convert it to another format for your own use;
- personally adapt and edit it;
- copy it as a back-up for your own use;
- [policy choice — to be confirmed: personal 3D printing];
- [policy choice — to be confirmed: use in the classroom or for educational purposes].
What you may not do: distribute the file itself. You may not distribute, resell, give away for free, upload to other platforms or asset libraries, or offer as a reusable component of a product or service the source file (or a largely similar, reusable version of it). This prohibition concerns the file as a reusable 3D asset — not what you make with it yourself:
- renders, screenshots and videos you make may be shared as provided in article 4 paragraph 3;
- physical prints you make yourself are covered by paragraph 2 of this article (3D printing as a [policy choice]);
- educational use is covered by paragraph 2 of this article ([policy choice]);
- commercial applications (for example using the file in paid products) are not permitted, unless Qoinomics offers a separate licence for this. [To be confirmed: whether and for which cases Qoinomics offers commercial licences.]
Personal and non-transferable (draft principle). The download right is in your name and does not automatically pass with any transfer of the platform right (article 7). If you later sell the platform item within the service, you keep your own download copy and download right — and the same applies the other way round for the buyer: the buyer does not get a download right, unless Qoinomics expressly arranges this for that item.
No claim of uniqueness. The download file is not proof of uniqueness or of your position within an edition; the registration in the service is (article 5).
Duration of the download right. The download right applies for an indefinite period, as long as you comply with these terms, and continues to exist if the service (or your account) ends (article 10).
Article 7 — Resale and transfer (draft choice)
Current status. In the current phase, resale of items between users is not active. (This is a draft choice: the original design of Qoinomics did provide for resale on an internal marketplace; whether and how it will be activated still has to be confirmed and legally reviewed.)
Basic principle on activation. If resale is activated later: on a valid transfer, the platform right ends for the seller and arises for the buyer; your own download right remains personal and does not pass (article 6 paragraph 4), and the buyer does not get a download right unless this is expressly arranged for the item. Before the purchase and before a resale, the service shows which rights pass, whether the buyer gets a download right, and that the seller keeps their own download right. The exact rules (prices, proceeds, credits) will be set out in separate marketplace terms published before activation, and will not be introduced retroactively for earlier purchases.
Trading outside the service. As long as and insofar as the service does not support transfers, selling, exchanging or giving away platform rights or items outside the service (on external websites or via social media) is not permitted and may lead to measures under the Terms and Conditions.
Article 8 — Technical protection and fraud
You may not circumvent technical security measures of the service and may not use tools to manipulate items or credits.
What the law permits remains permitted: such as making necessary back-ups and the mandatory exceptions to copyright (including quotations and technical interoperability insofar as the law permits).
If it is established that items or credits were obtained through fraud, Qoinomics only reverses the transactions demonstrably connected with that fraud, with reasons and the possibility to object — in accordance with article 13 of the Terms and Conditions.
Article 9 — Restoration, conformity and support
If your item is lost due to a technical error (for example an outage), Qoinomics restores its use where reasonably possible, on the basis of the registration.
If an item does not meet what was promised at purchase (description, edition size, download), your statutory rights for digital content apply: remedy or re-supply, an appropriate solution or (where the law allows) termination and (partial) refund. You can report this via [contact e-mail].
Lasting use versus support. The download right continues to exist without Qoinomics having to update or support the file forever: the purchase information states which format you get and what it works with. Qoinomics does supply necessary updates during the period required by law or the agreement, and does not have to support all future software versions after that, unless the law or the agreement provides otherwise.
Article 10 — Account termination and closure of the platform
Measures unrelated to the licence. The download right does not automatically end with a measure against your account that has nothing to do with this licence (such as a chat measure), nor when you voluntarily terminate your account. Your download file and download right continue to exist and remain usable.
Termination for breach of licence. If Qoinomics terminates the download right because of a breach of these terms, this requires a sufficiently serious, concrete breach, and the termination is: communicated with reasons, proportionate (not every minor violation justifies definitive loss of the download right) and, where appropriate, accompanied by an opportunity to remedy; you can object as provided in the Terms and Conditions.
Closure of the platform. If Qoinomics stops the service, it will announce this in accordance with article 23 of the Terms and Conditions, and the following applies: your in-world platform rights lapse when the world stops; your download file and download right continue to exist; before closure, Qoinomics opens a reasonable period in which you can download your files once more; and offline use of the file continues to work without you having to log in or needing a licence server. Losing access to the world does not mean waiving your statutory rights: conformity and refund rights continue to exist as set out in the Terms and Conditions and Payment Terms.
Article 11 — Intellectual property, chain of rights and misuse
The rights to the items, worlds and files lie with Qoinomics or with rights holders from whom Qoinomics has obtained the rights. Developing in-house does not automatically mean that all rights have been arranged; Qoinomics checks and documents the chain of rights (including any freelance and purchased components).
If you create content within the service yourself (such as cards or furnishings), article 5 of the Terms and Conditions applies (licence to Qoinomics for offering and securing the service).
If you see someone using another person's rights (for example a trademark, photo or model without permission), you can report this via the reporting channel in the service or via [contact e-mail]. Qoinomics handles reports of suspected illegal content in a timely manner and with reasons, in accordance with the Digital Services Act.
Article 12 — Minors
For minor users, the age rules of the Terms and Conditions apply (including the consent rules for purchases in the Payment Terms); these terms do not set their own, different age limits.
No extra age limit applies to download files, unless stated otherwise with an item.
Article 13 — Changes
Qoinomics may change these licence terms in accordance with the changes article of the Terms and Conditions (advance notice, clear explanation, option to terminate).
No adverse retroactive effect: changes do not apply to rights you have already bought, except where required by law or where you have expressly agreed in advance.
Article 14 — Applicable law and disputes
Dutch law applies to these terms, without prejudice to the mandatory consumer rights of your country of residence and your right to go to the court of your country of residence, as set out in article 24 of the Terms and Conditions.
You can submit complaints about items or downloads via [contact e-mail]; see also the complaints articles of the Terms and Conditions and Payment Terms.
